The existence of laws Is not enough to say that everything is good. those laws or sections of them might be under the selectivity, nepotism and exploitation .in that case the laws become informal and that the worst thing can happen to those law, because the environment of law enforcement turns into environment controlled by the law of jungle.
What we are talking about is the law of guarantee in the areas under the domination of the people’s protection units (YPG), which mind accepts that a Syrian citizen is asking another Syrian citizen to have a guarantee to allow him to enter the Syrian areas? plus, the people’s protection units soldiers are temperamental and arrogant in the enforcement of that law . Once they don’t enforce the guarantee law even if the migrant has a guarantor through the guarantee rejection and that what happened in Rajm slaibi checkpoint And another time they allow the migrant to enter even If he doesn’t have a guarantor by paying a huge amounts of money-bribes-to mediators so they let the migrant to enter the city in sight of the (YPG) soldiers. And sometimes they take the money and don’t allow the migrant to get into the city. Some people have returned to their villages and towns in DeirEzzor because they don’t have a guarantor and they can’t afford those huge amounts of money.
Laws like that shouldn’t be enacted. everyone has the right to enter any area which considers as his homeland. Not to mention that everyone has the right to enter without any guarantee and that from a humanitarian viewpoint. As under article 13 of the universal declaration of human rights :
(1) Everyone has the right to freedom of movement and residence within the borders of each state.
(2) Everyone has the right to leave any country, including his own, and to return to his country.
And under the article 12 of the International covenant on civil and political Rights
1. Everyone lawfully within the territory of a State shall, within that territory, have the right to liberty of movement and freedom to choose his residence.
- Everyone shall be free to leave any country, including his own.
- The above-mentioned rights shall not be subject to any restrictions except those which are provided by law, are necessary to protect national security, public order (ordre public), public health or morals or the rights and freedoms of others, and are consistent with the other rights recognized in the present Covenant.
- No one shall be arbitrarily deprived of the right to enter his own country.
Enacting laws like the law of guarantee is forcing stuck migrants to pay bribes, they stay at the checkpoint for days in the hope of getting into the city, besides that they are facing exploitation through selling them background materials like bread, water, etc. At extremely high prices.
The stuck migrants are suffering from a miserable living situation in the checkpoint, they don’t have any medical or relief services. There are sick people among them. and some of them died in the checkpoint ,a lot of them don’t have food or water or any money to buy their basic needs, they are sleeping on the ground. other migrants have found solutions, they digged holes in the ground to sleep in those holes and protect their women and children from wind, cold and rain.
On the other hand, there were migrants from DeirEzzor stuck in Rajm slaibi checkpoint, they didn’t come to reside and stay in AlHasaka city as migrants but to pass through it. Some of them work in one of the Arab Gulf states and have work visas there and any delaying in the checkpoint might cancel their visas. Others are working in Lebanon and might lose their jobs because of the delay at the checkpoint. Not to mention the sick people, children, women and elders there whom can’t bear difficult and inhuman situations .
Rajm Slaibi checkpoint is under the domination of the people’s protection units (YPG) and considers as the borderline between the areas under the domination of the Islamic state in DeirEzzor and the areas controlled by the people’s protection units (YPG) in AlHasaka.
The justice for life in DeirEzzor observatory is Demanding:
Firstly, The people’s protection units (YPG):
1. To allow the Syrian civilians to enter the areas under the domination of the (YPG) especially the migrants from DeirEzzor Governorate because they are suffering from a very difficult humanitarian and living situations.
2. Accelerating the entry of the stuck people at Rajm slaibi checkpoint to AlHasaka city and overcome the obstacles in front of them. Especially the women, children and sick people.
3. the abolition of the guarantor requirement because it’s illegal, inhuman and it’s a big obstacle in front of migrants.
Secondly, the countries that have relations with the ( YPG):
The observatory is demanding the countries which have relations with the people’s protection units especially the United States of America And Russia to put pressure on the (YPG) leadership to abolish the law of guarantee and allow the Syrian civilians to enter the areas under the domination of the (YPG)
Thirdly, the civil society in AlHasaka governorate:
1.the observatory is demanding all the organizations of civil society and the human rights Activists in the areas under the domination of the (YPG) especially AlHasaka governorate to put a pressure on the people’s protection units to facilitate the entry of Syrian migrants .
2. to provide all the assistance as soon as possible to the people in Rajm slaibi checkpoint and that’s because it’s nonexistence and to prevent some people from exploiting the migrants.
